LuxStory no otorga esas licencias.
Anthropic y Google).
7. Disponibilidad y almacenamiento
No garantizamos uptime 100%.
13. Contacto
Legal: legal@luxstory.app. Soporte: support@luxstory.app.
- Ayuda: responde HELP o escribe a support@luxstory.app.
15. Cobros a tus clientes (Stripe Connect)
Terms of Service
LuxStory LLC is a Texas limited liability company. Address for public notices: Austin, Texas, United States.
1. The service
LuxStory is cloud software for video and photo studios: team accounts, clients, projects, video (HLS) and photo galleries, client portal, share links, contracts and forms, CRM, email, analytics, subscription billing, and AI features (copy, highlights, invitations, and similar).
The service is provided “as is.” Beta features (for example TV apps or Cast without a custom receiver ID) may change or stop.
2. Eligibility and account
- You must be at least 18 and able to contract.
- You are responsible for credentials, 2FA, team members, and their actions.
- A view-only role cannot mutate business data; billing, password, and team actions stay with the owner.
- Registration requires accepting these Terms, the Privacy Policy, and Acceptable Use. We will store version and acceptance date once the product records it.
3. Plans, payment, refunds
Plans (Starter, Pro, Business or others we publish) and limits on storage, download quality, and seats appear on the pricing page and in your dashboard. Stripe processes payment. Stripe’s terms also apply.
- Fees recur until you cancel. Cancellation stops the next cycle; it does not require a refund of the current period unless Texas law or a then-published policy says otherwise.
- Non-payment, a chargeback, or a cancelled subscription status may suspend access, including your clients’ portal.
- You are responsible for taxes on your business.
4. Your content and copyright
LuxStory is a presentation and delivery medium: we host and display the photos, video, and music the studio uploads so the studio can share them with its clients. We do not produce the event, license music, or own the material.
The videographer or photographer is solely responsible for copyright in: (a) the video and photos; (b) music, songs, and third-party works synced or embedded; (c) third-party trademarks and clips. They must have the rights or licenses (including synchronization / repertoire such as ASCAP, BMI, SESAC, or otherwise) before uploading. LuxStory does not grant those licenses.
You keep all rights in what you upload (“Studio Content”). You grant us only a limited, non-exclusive license to host, transcode (e.g. HLS), make thumbnails, deliver to people you authorize, back up, and operate the service.
You are also responsible for likeness rights and minors at the event, and for the contract with your end client. LuxStory is not a party to that contract. In-product templates are not legal advice.
Marketing images on luxstory.app (including the homepage cover and gallery mockups) are AI-generated visuals. They are not third-party stock photographs and were not taken from the internet.
5. Portal, links, and TV
Clients sign in with a password, one-time codes, or gallery share links. Anyone with an active link can view or download what that link allows. HLS playback sessions and TV pairing are short-lived by design. Do not publish raw storage URLs.
6. Artificial intelligence
If you use AI modules, we may send prompts, event metadata, and, when the flow requires it, frames or text to model providers (e.g. Anthropic and Google). We do not use your content to train our own models. We do not control whether a provider trains on API data; we rely on their then-current API terms. AI output can be wrong; you review it before sending it to a client.
7. Availability and storage
We do not guarantee 100% uptime. After cancellation or an account-deletion request, we may retain data for up to 36 months (backups, disputes, legal duties) unless law or the DPA requires otherwise. The delete-account control disables access immediately; physical deletion of storage objects is a later process.
8. Suspension
We may suspend or terminate for non-payment, abuse, security risk, legal order, or breach of these Terms or Acceptable Use.
9. Disclaimers and liability cap
To the extent Texas law allows, the service is provided without implied warranties of merchantability or fitness. Our total liability for claims related to the service in any 12-month period will not exceed the subscription fees you paid us in the month before the claim (or one month of your then-current plan). We are not liable for lost profits, data you failed to back up, or claims by your end clients or music rights holders.
10. Indemnity
You will indemnify us against third-party claims arising from your Content, your clients, music licenses, or unlawful use of the service, including reasonable costs.
11. Changes
We may update these Terms. Notice will appear at this URL with a new version date. Continued use after the effective date is acceptance unless law requires express consent.
12. Governing law
Texas law governs, excluding conflict-of-law rules. Exclusive venue is the state or federal courts in Texas, preferably in the county of our principal office.
13. Contact
Legal: legal@luxstory.app. Support: support@luxstory.app.
14. Text Messages (SMS)
LuxStory and the studios that use it may send you text messages (SMS) related to your account or the services you hired: payment confirmations, appointment reminders, notices that your gallery or video is ready, and links to your portal or invoice. We do not send marketing SMS.
- Frequency: varies based on your activity (typically 1–4 messages per event or transaction).
- Rates: message and data rates may apply.
- To opt out: reply STOP to any message.
- Help: reply HELP or email support@luxstory.app.
- Consent to receive SMS is not a condition of purchasing any service.
- We do not share your phone number with third parties for marketing purposes.
15. Collecting payments from your clients (Stripe Connect)
This section applies if you connect a Stripe account to receive payments from your clients through LuxStory (invoices, deposits and other charges).
- Stripe account. To receive those payments you must connect a Stripe account (Stripe Connect Express). By connecting it you accept Stripe's terms for connected accounts, including the Stripe Connected Account Agreement. Stripe, not LuxStory, verifies your identity and processes payments and payouts to your bank. LuxStory is not a bank or financial institution.
- You are the seller. Your clients' payments are collected in your Stripe account and are for services you provide. You alone are responsible for those services, your contracts with your clients, your prices, your refund policy and your taxes, including any tax forms Stripe issues (for example, 1099-K). LuxStory is not a party to the relationship between you and your clients.
- Fees. For each invoice payment you are charged Stripe's processing fees plus a LuxStory fee, shown in Settings → Plan & Storage. Stripe's fees are not returned when a payment is refunded. LuxStory may change its fee with 30 days' notice.
- Refunds, disputes and chargebacks. You are responsible for refunds, disputes and chargebacks on the payments you receive, including the amounts, Stripe's dispute fees and any applicable penalties. You can refund from LuxStory or from Stripe.
- Negative balances. If your Stripe account ends up with a negative balance (for example, a refund or chargeback larger than your available balance) and Stripe does not recover it from your bank account or your future payments, and LuxStory covers it, you agree to reimburse LuxStory that amount, plus reasonable collection costs, within 15 days of our notice. You authorize LuxStory to recover it (i) by offsetting it against any payments or balances we hold for you, (ii) by charging the card you have on file for your subscription, or (iii) by any other means permitted by law.
- Payouts and holds. Payouts to your bank may be delayed by up to 7 days or more, or held, when Stripe or LuxStory reasonably considers it necessary to cover potential refunds, disputes or fraud risk.
- Suspension. LuxStory may pause your ability to collect payments online, or close your account, if Stripe restricts your connected account, if there is an unusual rate of disputes or refunds, if fraud is suspected, or if you leave an amount owed to LuxStory unpaid.
- Information. You authorize us to share with Stripe the information needed to operate your collections, and to receive from Stripe information about the status of your account and payments.
16. Print store
This section applies when LuxStory turns on the print store for your account (prints, canvas and metal your clients buy from their galleries). Until it is turned on for you, nothing is charged or printed.
- How it works. The client pays by card through Stripe to LuxStory's account. LuxStory sends the order to the print lab (currently WHCC), which prints it and ships it directly to the client. LuxStory appears as the sender and the packaging carries no third-party branding. From the amount charged we pay the lab, Stripe's fees and LuxStory's fee, and the rest is your earnings, credited to your LuxStory wallet.
- Fee. LuxStory charges a percentage of your margin (sale price minus the lab's product cost). During the beta it is 0%; afterwards it is 10% of the margin, and we will give you 30 days' notice before any change. The current percentage is shown in Settings → Print store.
- Your wallet and withdrawals. Your earnings are held for 7 days before they can be withdrawn (to cover refunds and disputes). After that you can withdraw them to your bank, manually or automatically, with a $1.00 minimum, from Settings. Payouts are made through Stripe Connect and the terms in section 15 apply.
- Taxes. Any sales tax that applies to the order is shown to the client before paying. You are responsible for your own tax obligations on your earnings, including any forms Stripe issues (for example, 1099-K). The shipping regions (states where we sell) are set by LuxStory and may expand over time.
- Cancellations. An order can only be cancelled before it has been sent to the lab. Once sent, the lab starts production immediately and it can no longer be cancelled or changed. If cancelled in time, the client is refunded in full.
- Damaged shipments. If an order arrives damaged, the client should not refuse the package: they must notify LuxStory within 14 days of delivery, with photos of the product and the packaging. LuxStory requests a replacement from the lab and ships it at no cost to the client. When the damage or printing defect is shown with photos, the replacement may be approved immediately and automatically (once per order).
- Marked as delivered but not received. If tracking says “delivered” and the client did not receive the order, they should check with neighbors, mailbox or front desk and notify LuxStory. If it does not turn up 2 business days after the marked delivery, LuxStory opens a claim with the lab and the carrier and replaces the order at no cost to the client, without waiting for the claim to be resolved. A replacement for this reason is made once per order; in a second case LuxStory may ask to verify the delivery address.
- Lost orders or lab errors. If an order does not arrive within a reasonable time after shipping, or arrives with a printing defect or a different product than ordered, LuxStory works with the lab and the carrier to provide a free replacement or, if a replacement is not possible, a refund.
- Reprints and client errors. Replacements use the same products and the original files of the order. Orders fulfilled as placed (for example, wrong photo, crop, size or file changes) are not refunded or reprinted for free; the client can place a new order. Colors may vary slightly between screen and print; that is not a defect.
- Refunds. LuxStory prefers to replace rather than refund. An order that has already been printed is not refunded unless a replacement is not possible or the error is LuxStory's (for example, a duplicate charge). When an order is refunded, the corresponding earnings are reversed in your wallet.
- Photo content. You are responsible for holding the rights to the images that are printed and for them not violating the law or the acceptable use policy. LuxStory and the lab may reject orders with prohibited content.
- Liability. The lab and carriers are independent third parties. LuxStory does not guarantee production or delivery times and is liable at most up to the amount of the affected order.
